The Cushman Decision: A Whole New World for Hydro?
SESSION LEADER: Nino Mascolo, Southern California Edison Company Last August, the U.S. Court of Appeals for the District of Columbia Circuit issued a decision in City of Tacoma v. FERC, addressing significant issues in hydropower licensing. These included: the scope of mandatory conditioning authority under Section 4(e); FERC's regulatory deadlines for submittal of mandatory conditions; and FERC's authority to issue "uneconomic" licenses. Learn how the court resolved these issues and how the landscape for hydropower licensing may have changed.
